H-1B rules changed in 2026

  • Wage-weighted selection. The random lottery was replaced: higher wage levels get more entries, so well-paid offers are much more likely to be selected.
  • $100,000 fee on hold. The fee for new petitions for people outside the US was struck down in court and is not being collected, although the administration extended the policy and has proposed new fees.
  • Closer review. Petitions now face more scrutiny, especially from employers with recent layoffs, and higher prevailing wages have been proposed.

Three ways to hire on an H-1B

The right route depends on whether the candidate already holds H-1B status and what kind of employer you are.

New H-1B (cap-subject)

For most private-sector employers hiring someone who has never held H-1B status.

  • 85,000 visas a year: 65,000 regular plus 20,000 for US master's degree holders
  • Selection is now weighted by wage level, so higher-paid offers have better odds
  • If selected, the full petition is filed from April to June

H-1B transfer

Year-round · no lottery

For professionals who already hold H-1B status in the US and are changing employers.

  • Already counted against the cap, so no new selection is needed
  • The person can usually start once the new petition is filed
  • The fastest way to bring an H-1B professional onto a client project

Cap-exempt H-1B

Year-round · no lottery

For universities, their affiliated nonprofits, and nonprofit or government research organizations.

  • No annual limit applies to these employers
  • Petitions can be filed whenever the role opens
  • Common for research, teaching and academic medical roles

How the visa filing works

The usual timeline for a new cap-subject H-1B. Transfers and cap-exempt cases skip registration and can be filed any time of year.

    Before registration

    The job offer is confirmed and the wage is set at or above the prevailing wage for the role and location.

  2. 02

    Registration & selection

    March

    For cap-subject cases, the employer registers the candidate online. Selections are announced by the end of March.

  3. 03

    Labor Condition Application

    About 7 working days

    The employer files an LCA with the US Department of Labor confirming the wage and working conditions.

  4. 04

    H-1B petition

    April – June

    Our partner attorneys file Form I-129 with USCIS. Premium processing gets a decision within 15 business days.

  5. 05

    Visa interview

    After approval

    Candidates outside the US book a visa interview at a US embassy or consulate in their home country.

  6. 06

    Arrival & onboarding

    From October 1

    The professional travels to the US and starts work. We support relocation and onboarding paperwork.

H-1B questions, answered

Is there still an H-1B lottery?+

Yes, for new cap-subject petitions. Since the FY 2027 season, selection is weighted by wage level: a registration at the highest wage level (IV) gets four entries, level III gets three, level II two and level I one. H-1B transfers and cap-exempt employers are not part of the selection.

What happened with the $100,000 H-1B fee?+

A September 2025 presidential proclamation required a $100,000 payment for certain new H-1B petitions for people outside the US. A federal court vacated the policy in June 2026 and the appeals court upheld that in July 2026, so the fee is not being collected. A new proclamation in September 2026 extended the policy to September 2027, and a separate fee for all cap-subject petitions has been proposed. We check the current status for every case before filing.

How long can someone stay on an H-1B visa?+

The first approval is for up to 3 years and can be extended to a maximum of 6 years. Extensions beyond 6 years are possible when a green card process is far enough along. A spouse and children under 21 can come on H-4 visas.

Who pays the H-1B costs?+

The employer. US law requires the employer to pay the petition filing fees and its own attorney fees, and they cannot be passed on to the employee or deducted from pay below the required wage. Candidates usually pay their own visa interview fee and travel unless the offer covers them.

Can a candidate pay Khani SC to get an H-1B job?+

No. Khani Staffing Tech Corp never charges candidates for job placement or for H-1B petition costs. If anyone asks you to pay for an H-1B job offer in our name, please report it to admin@khanisc.com.

Do nurses qualify for H-1B?+

Only some nursing roles qualify, usually advanced or specialized positions that require a bachelor's degree or higher, such as nurse practitioners or certain nurse managers. Most staff registered nurse positions go through a green card instead. We review each role before starting a search.

What if the candidate is not selected in the lottery?+

Unselected candidates can be registered again the next March. In the meantime we can look at other routes: an H-1B transfer for someone already in H-1B status, cap-exempt employers, or other visas such as TN (Canada and Mexico), E-3 (Australia), H-1B1 (Chile and Singapore) or O-1 for extraordinary ability.
